O pluralismo linguístico que caracteriza o sistema jurídico da União Europeia é
um dos traços mais originais do processo de construção europeia. E é também um dos
seus maiores desafios. A configuração linguística da União Europeia ilustra bem afinal os
paradoxos do processo de integração, inscritos, de resto, de forma assaz eloquente, no
próprio lema da União Europeia – “unida na diversidade”.
A questão da língua tem dado origem a um intenso debate doutrinário que
confronta precisamente o desiderato da diversidade linguística com outras dimensões de
um projecto que aspira a uma “união mais estreita entre os povos”. Não raras vezes,
porém, esse debate parte de compreensões incorrectas do regime linguístico da União
Europeia.
O presente artigo pretende apresentar, ainda que de forma resumida, as regras
relativas ao uso da língua na União Europeia. Esta análise permitirá demonstrar que o
regime linguístico da união Europeia não assegura a igualdadedas línguasdos Estados-
Membros, estabelece apenas uma espécie demultilinguismo de intensidade variável. Mas,
ainda assim, reconhece aos cidadãos o direito a falar a sua língua na comunicação com as
instituições e os órgãos consultivos da União, desde que essa língua seja uma das línguas
da União. Para além de também garantir o acesso à legislação e à justiça nas vinte e quatro
línguas da União.

Thisarticle presents an overview ofthe rules concerning theuse of languagein the EuropeanUnion. This analysiswill show that the language regimeof the EuropeanUniondoes not guaranteeequality of the Member States languages.Instead, the language regimeof the European Unionestablishes a sort ofmultilingualismofvarying intensities.Nevertheless, it recognizes citizens'right tospeak their language, if that language isone of the twentyfour officiallanguages of theUnion, in communicationwith the institutionsand advisory bodiesof the Union, in addition to ensuring accessto Union legislationandjusticein one of thelanguages of the Union
