O Termo de Ajustamento de Conduta e o Processo Administrativo Disciplinar
são duas formas diferentes utilizadas pela Administração Pública em casos de
mĆ” conduta de servidores pĆŗblicos. O escopo precĆpuo da presente dissertação
Ć© expor o Termo de Ajustamento de Conduta de servidores, as oportunidades
e os desafios derivados de sua utilização para a Administração Pública e para
os próprios servidores públicos. Esta anÔlise é realizada considerando-se o
universo do Instituto Federal Farroupilha, que é uma organização educativa e,
como tal, possui suas peculiaridades, as quais tambƩm foram abordadas,
sobretudo, as questƵes do controle hierƔrquico e do poder disciplinar da
administração. Conceitos, princĆpios, natureza, legislação referentes ao PAD e
ao TAC, entre outros aspectos, foram aprofundados. Uma pesquisa nos
processos e termos finalizados existentes foi realizada, colacionando-se dados
importantes, como tempo de duração, tipo de faltas cometidas e parecer final,
dentre outros. Por último, foram coletados os pareceres da Comissão formada
para conduzir os processos e os termos, a fim de captar a opinião de cada um
deles, baseada na sua própria experiência, a respeito dos tipos e suas
particularidades, extraindo-se as vantagens e desvantagens. Os modelos
sofrem, ao longo do estudo, uma comparação em toda a sua extensão,
objetivando-se ampliar e aprofundar o conhecimento sobre ambos e visualizar
um resultado sobre sua efetividade e aplicabilidade.
The Term of Adjustment of Conduct and the Disciplinary Administrative Process they are two different forms used by the Public Administration in cases of bad conduct of public servants. The mark main of the present dissertation is to expose the Term of Adjustment of Conduct of servants, the opportunities and the derived challenges of it use for the Public Administration and for the own public servants. This analysis is accomplished being considered the universe of the Federal Institute Farroupilha, that is an educational organization and, as such, it possesses their peculiarities, which they were approached also, above all, the questions of the hierarchical control and of the power to discipline of the administration. Concepts, beginnings, nature, legislation regarding Disciplinary Administrative Process and to Term of Adjustment of Conduct, among other aspects, they were deepened. A research in the processes and terms concluded existent was accomplished, being collated important data, as time of duration, type of committed lacks and to seem final, among others. Lastly, were collected the opinions of the Commission formed to drive the processes and the terms, in order to capture the opinion of each one of them, based on it own experience, about the types and their particularities, extracting the advantages and disadvantages. The models suffer, along the study, a comparison in all its extension, being aimed at to enlarge and to deepen the knowledge on both and to visualize a result on it effectiveness and applicability
