A contratação pública em Portugal foi desde muito cedo uma das matérias mais relevantes de estudo e de constante transformação. Ao longo dos anos tem-se tentado ajustar às diretivas comunitárias europeias, e sobretudo, ao país.
Com a entrada em vigor do Código dos Contratos Públicos em 2008, a contratação pública mudou completamente, com introdução de um conceito mais acentuado e funcional relativamente a erros e omissões, tendo-se também introduzido a contratação pública eletrónica, que visa trazer a igualdade e a transparência aos concursos.
Contudo, já nesse mesmo ano, após publicação, o legislador começou a preparar a revisão do código, e em 2012 introduziu algumas alterações. Em 2014 com a exigência das três diretivas comunitárias, tinha início o estruturamento de um novo código ou, simplesmente, a concretização de alterações ao código existente, o que implica que todas as entidades tenham de acompanhar todas estas alterações.
Os erros e omissões nas empreitadas de obras públicas não foram um conceito novo que o código trouxe, pois já no Decreto-lei nº 59/99 de 2 de março, os erros e omissões surgiam como um tema distinto dos trabalhos a mais, contudo a legislação não se encontrava preparada para os aplicar separadamente. Em 2008, os erros e omissões apareceram com maior impacto na contratação pública gerando um descontentamento por parte de várias entidades. Os erros e omissões sempre foram e ainda são um tema bastante discutido, tendo em conta que se trata de um conceito que o legislador português aplicou e que não fora imposto pelas diretivas.
Esta dissertação foi para além do conceito de erros e omissões, alongando-se na análise da evolução histórica da contratação pública em Portugal, das plataformas eletrónicas de contratação pública nas diretivas comunitárias de 2014. São quatro capítulos diferentes, no entanto, interligam e dão uma perspetiva diferente do conceito de erros e omissões nas empreitadas de obras públicas.
Public procurement in Portugal has been from very early on one of the most relevant and ever-changing subject matters. It has throughout the years tried to adjust to the European Community Directives, but mainly to the country itself. With the entry into force of the Public Procurement Code in 2008, public contracting changed completely introducing a more marked and functional concept of errors and omissions, as well as the electronic public procurement, which aims to bring equality and transparency to contests. However, in that same year, after publication, the legislator started to prepare a revision of the code and, in 2012, he introduced some changes. In 2014, following the demand of the three Community Directives, the structuring of a new code or simply alterations to the pre-existent one began. This obliged all entities to accompany all of these changes. The errors and omissions in the public works contracts were not a new concept brought by the Code, because they had already appeared in the Decree no. 59/99 of March 2nd as a distinct topic. However, the legislation was not prepared to apply them separately. In 2008, errors and omissions arose with a bigger impact on public procurement generating discontent among several entities. Errors and omissions have always been and still are a much-discussed subject, considering it is a concept that was applied by the Portuguese legislator and was not imposed by the directives. This dissertation went beyond the concept of errors and omissions and also dwelled on the historic evolution of public procurement in Portugal as well as on the electronic platforms of public procurement, and the European Community directives of 2014. They are four different but interconnected chapters which give a different perspective on the concept of errors and omissions in public works contracts.
