Abstract(s)
O principal objetivo do processo de insolvĂȘncia Ă© a satisfação dos direitos dos credores. Assim sendo, o pedido de declaração da insolvĂȘncia pode ser efectuado pelo prĂłprio devedor, ou pelos credores, quando para tal estĂŁo legitimados.
Tem legitimidade para apresentar o pedido de declaração de insolvĂȘncia, nos termos do artigo 20Âș do CĂłdigo da InsolvĂȘncia e da Recuperação de Empresas, qualquer credor, qualquer que seja a natureza do seu crĂ©dito e o MinistĂ©rio PĂșblico, em representação das entidades cujos interesses lhe estĂŁo legalmente confiados, desde que verificado um qualquer facto-Ăndice aĂ previsto.
Estes factos-Ăndice sĂŁo considerados pressupostos legais e cada um, por si sĂł, Ă© condição necessĂĄria para que seja declarada a insolvĂȘncia, cabendo ao devedor o Ăłnus de alegar e provar que nĂŁo se encontra na situação invocada pelo credor, requerente da declaração de insolvĂȘncia, nos termos do artigo 30Âș do CIRE.
Relativamente ao crĂ©dito, quando controvertido, subsistem duas opiniĂ”es que tĂȘm vindo a ser debatidas na jurisprudĂȘncia. Uma sustenta que o crĂ©dito tem de estar reconhecido judicialmente, para que seja reconhecida legitimidade ao credor para requerer a declaração de insolvĂȘncia. A outra, sustenta que o processo de insolvĂȘncia Ă© competente para verificar a existĂȘncia do crĂ©dito, conferindo legitimidade ao credor, cujo crĂ©dito Ă© litigioso, para requerer a insolvĂȘncia.
Insolvencyâs main goal is to satisfy creditorâs rights. Therefore, the request for the insolvency declaration may be done by the debtor or by the creditor, when theyâre allowed to do it. In the terms of the article twenty of CĂłdigo da InsolvĂȘncia e da Recuperação de Empresas, any creditor, no matter the creditâs nature, and the Public Ministry while representing entities that legally trust the ministry with their interests are allowed to present the request for the insolvency declaration as long as itâs verified any index-factor. The index-factors are considered legal assumptions and each one by itself is the necessary condition to declare insolvency leaving the debtor the obligation of alleging and proving that he isnât in the situation invoked by the creditor that is applying for the insolvency declaration in the terms of the article 30Âș of CĂłdigo da InsolvĂȘncia e da Recuperação de Empresas. As far as the credit goes, when it is controversial, there are two opinions being discussed in the jurisprudence. One defends that the credit must be recognized by a court so that the creditor may be allowed to request the insolvency declaration. The other, defends that the insolvencyâs process is qualified to verify the credit existence giving legitimacy to the creditor whose credit is litigious to request insolvency.
