Abstract(s)
Com o presente estudo sobre o dano da perda de chance por ato médico, pretendemos contextualiza-lo nos princípios da responsabilidade civil e da indemnização realçando a tutela do doente lesado perante a atuação do profissional de saúde em situações que por um facto ilícito e culposo, e face à impossibilidade de estabelecer um nexo de causalidade existente, se averiguará se será (ou não) de aceitar a sua ressarcibilidade.
À controvérsia a nível doutrinário que rodeia a temática, acresce a falta de suporte legislativo porquanto poderão os ordenamentos jurídicos não ter como acolher a figura e, por tal, não ter como prover ao ressarcimento da perda do dano decorrente da perda de uma chance.
A nível jurisprudencial, o presente estudo permitirá concluir que a tendência atual é a de aceitar a ressarcibilidade do lesado pela perda de uma chance no âmbito da responsabilidade civil por ato médico.
A final faremos uma reflexão para saber se o dano aqui em análise caberá nos princípios informadores da responsabilidade civil e se cumpre os requisitos que justificarão a sua ressarcibilidade.
A perda de chance (ou de oportunidade) por ato médico apresenta-se como um tema de grande atualidade quando perspetivada como um dano, também ele a ser indemnizado à luz do instituto da responsabilidade civil, e que gera controvérsia no ordenamento jurídico constituído, porquanto poderá este não ter como acolher a figura, e por tal não ter como prover ao seu ressarcimento.
With this study on the damage of loss of chance due to a medical act, we intend to contextualize it in the principles of civil responsibility and compensation, highlighting the protection of the injured patient in the face of the actions of the health professional in situations that, due to an unlawful and culpable act, and in view of the impossibility of establishing an existing causal link, it will be ascertained whether it will be (or not) to accept its recoverability. To the controversy at the doctrinaire level that surrounds the theme, we must add the lack of legislative support, since legal systems may not be able to accept the figure and, therefore, may not be able to provide compensation for the loss of damage resulting from the loss of a chance. At a jurisprudential level, the present study will allow us to conclude that the current tendency is to accept the compensation of the injured party for the loss of a chance within the scope of civil responsibility for medical acts. At the end, we will reflect on whether the damage under analysis here fits into the principles that inform civil responsibility and if it meets the requirements that will justify its compensability.
