Abstract(s)
O presente trabalho tem como principal objetivo analisar a privacidade do teletrabalhador, no âmbito do teletrabalho.
Para o efeito, começamos por fazer um breve enquadramento do regime jurídico do teletrabalho em Portugal, abordando as mais recentes alterações legislativas introduzidas pela Lei n.º 13/2023, de 3 de abril.
Definimos o conceito de teletrabalho, analisamos as principais características e as várias modalidades do teletrabalho e o impacto que o teletrabalho pode ter na vida pessoal e profissional do teletrabalhador.
De seguida, centramo-nos na privacidade do teletrabalhador, para isso analisamos a subordinação jurídica no contexto do teletrabalho e os meios de vigilância à distância que o empregador tem ao seu dispor, os quais podem comprometer os direitos do teletrabalhador.
Deste modo, procuramos identificar as principais dificuldades e os maiores desafios que se colocam relativamente ao meio de controlo que o empregador deve adotar sem invadir o direito à privacidade e à intimidade da vida privada do teletrabalhador.
Pretendemos, também, apresentar eventuais soluções para os problemas elencados, enumerando os princípios que devem ser respeitados.
Por fim, realçamos algumas diferenças entre o regime nacional e o direito à privacidade no regime jurídico-laboral espanhol.
The main objective of this work is to analyze the privacy of teleworkers in the context of telework. To this end, we begin by providing a brief overview of the legal regime of telework in Portugal, addressing the most recent legislative changes introduced by Law No. 13/2023, of April 3rd. We define the concept of telework, analyze the main characteristics and the various modalities of telework and the impact that telework can have on the personal and professional life of the teleworker. Next, we focus on the privacy of the teleworker, for this we analyze the legal subordination in the context of telework and the means of remote surveillance that the employer has at its disposal, which can compromise the rights of the teleworker. In this way, we seek to identify the main difficulties and the greatest challenges that arise in relation to the means of control that the employer must adopt without invading the right to privacy and intimacy of the private life of the teleworker. We also intend to present possible solutions to the problems listed, listing the principles that must be respected. Finally, we highlight some differences between the national regime and the right to privacy in the Spanish legal-labor regime.
