Abstract(s)
A presente dissertação abarca um estudo sobre o Erro Médico no contexto da Responsabilidade Civil Contratual, promovendo um novo enfoque do tema face a vulnerabilidade a que estão sujeitos, não só os pacientes mas também os médicos durante o exercício profissional, dado o caráter subjetivo e imprevisibilidade do corpo humano, bem como da impossibilidade de a ciência fornecer respostas para todas enfermidades que afetam o homem. A abordagem insere um desenvolvimento sobre a dicotomia entre a responsabilidade civil contratual e extracontratual do médico que cause prejuízos à saúde do paciente por Imperícia, Imprudência ou Negligência. A análise dos pressupostos para o levantamento da responsabilidade civil contratual do médico, os critérios de reparação do dano, o dever de apresentação do ónus da prova imposto ao paciente para certificação da culpa do médico, a par da análise do nexo de causalidade entre o facto e o dano e as modalidades de responsabilização do profissional quando provada a sua atuação culposa serão igualmente objeto de análise no presente trabalho que insere também um estudo comparado sobre a Responsabilidade Contratual do Médico no Direito Português e em países da Europa, América e África.
This dissertation encompasses a study on Medical Error in the context of Contractual Civil Liability, promoting a new approach to the issue in view of the vulnerability to which patients and physicians are subject during the exercise, given the subjective nature and unpredictability Of the human body, as well as the impossibility of science providing answers to all diseases that affect man. The approach introduces a development on the dichotomy between contractual and no contractual civil liability of the physician that causes harm to the patient's health due to Malpractice, Imprudence or Negligence. The analysis of the assumptions for the removal of contractual civil liability of the physician, the criteria for repairing the damage, the obligation to present the burden of proof imposed on the patient to certify the doctor's guilt, together with the analysis of the causal link between the fact And the damage and modalities of liability of the professional when proven guilty will also be the subject of analysis in this paper which also includes a comparative study on the Contractual Responsibility of the Doctor in Portuguese Law and in countries in Europe, America and Africa.
