This dissertation investigates the intersection between Legal Translation and Comparative Law, focusing on the transposition of instruments of voluntary representation from Germany and the Netherlands into the Portuguese legal system. The study identifies a profound dogmatic clash. The German and Dutch systems prioritise celerity and the protection of reliance; consequently, their general powers of attorney (Generalvollmacht and algemene volmacht) implicitly encompass acts of asset disposal. In contrast, Portuguese law imposes a protective, formalistic rigour. Under Article 1159 of the Civil Code, a general mandate is confined to acts of ordinary administration, strictly requiring express powers for the disposal of assets. Consequently, it is demonstrated that a strictly literal translation can lead to the legal ineffectiveness of the document. To overcome this obstacle, the research crosses macro- and micro-comparison with Legal Translation Studies. Grounded in Vermeer’s Skopos Theory, Šarčević’s Functional Equivalence, and Prieto Ramos’s Integrative Legal Translation model, the study proposes abandoning purely lexical equivalence. Through the application of a functional analysis grid to templates of power of attorney, it is proven that the legal translator must assume the role of a transsystemic mediator. It is concluded that resorting to compensatory strategies, namely explicitation and the well-founded insertion of Translator’s Notes (T.N.), is indispensable. This approach clarifies the original ratio legis and preserves the illocutionary force of foreign performative acts, ensuring the substantive validity of these instruments within transnational legal transactions.
