Este trabalho teve como objetivo geral discutir de que forma a capacitação e preparação profissional dos gestores e fiscais de contrato podem contribuir para a prevenção da responsabilização subsidiária do Instituto Federal Farroupilha Campus Santo Augusto junto à Justiça do Trabalho, e com objetivos específicos de (1) investigar a legislação e a jurisprudência atualizada relativa ao fenómeno da Terceirização na Administração Pública e à fiscalização dos contratos administrativos; (2) conhecer quais são as principais reclamações trabalhistas em que o Campus Santo Augusto responde como parte; (3) identificar quais são as maiores dificuldades encontradas pelos servidores na gestão e fiscalização de contratos e (4) analisar as ações dos servidores com funções gerenciais referente às políticas de capacitação a fim de se prevenir a responsabilização subsidiária em causas trabalhistas. A investigação foi conduzida na Reitoria e no Campus Santo Augusto do Instituto Federal Farroupilha e também na Vara do Trabalho do Município de Três Passos/RS. Foi adotada uma abordagem qualitativa, na forma de estudo de caso. Como instrumento de recolha de dados foi utilizada a pesquisa documental, o inquérito por questionário e o inquérito por entrevista os quais tiveram participação de quinze servidores públicos com funções de gestão e fiscalização e funções gerenciais de coordenação e de direção. Os resultados demonstraram que existe a previsão legal da possibilidade de a Instituição ser responsabilizada de forma subsidiária pela Justiça do Trabalho, a qual é afastada quando se comprove que a Instituição, por meio dos fiscais e gestores de contrato, executa as suas obrigações dentro das previsões legais, e que a política de capacitação profissional desenvolvida pela Instituição não está plenamente implementada trazendo insegurança para o servidor no desempenho das funções de fiscalização e de gestão de contratos.
This work had as general objective to discuss how the training and professional preparation of contract managers and prosecutors can contribute to the prevention of the subsidiary accountability of the Federal Institute Farroupilha Campus Santo Augusto to the Labor Court, and with specific objectives of (1) to investigate the legislation and the updated jurisprudence on the phenomenon of Outsourcing in the Public Administration and the supervision of administrative contracts; (2) to know what are the main labor claims in which the Santo Augusto Campus responds as a party; (3) to identify the greatest difficulties encountered by the employees in the management and supervision of contracts and (4) to analyze the actions of the employees with management functions related to training policies in order to prevent subsidiary liability in labor claims. The research was conducted in the Rectory and Campus Santo Augusto of the Federal Institute Farroupilha and also in the Labor Court of the Municipality of Três Passos / RS. A qualitative approach was adopted, in the form of a case study. As a data collection instrument, documentary research, the questionnaire survey and the interview survey were used, with the participation of fifteen public servants with management and supervisory functions and management and coordination functions. The results showed that there is a legal provision for the Institution to be held liable in a subsidiary manner by the Labor Court, which is dismissed when it is established that the Institution, through the fiscal and contract managers, performs its obligations within the forecasts and that the professional training policy developed by the Institution is not fully implemented, causing insecurity for the server in performing the functions of supervision and contract management.
