dc.description.abstractA Diretiva (2011/95/EU) estabelece as condições que os requerentes de proteção internacional têm de preencher para dela usufruírem. Insere-se a mesma no SECA, contribuindo para estabelecer na Europa um Espaço de Liberdade, Segurança e Justiça, aberto aos nacionais de Estados terceiros que se encontrem forçados a procurar proteção na União. Assentando no respeito pela Convenção de Genebra relativa ao Estatuto de Refugiados de 1951, o SECA inclui medidas complementares para proteger pessoas em risco de sofrerem ofensas graves aos seus direitos mais fundamentais. Os pedidos de asilo são individualmente apreciados pelas autoridades do Estado onde o requerente se encontre, se o mesmo comprovar um fundado receio de sofrer atos de perseguição ou ameaças de perseguição, em função de um elenco apertado de motivos, caso regressem ao país de origem. Sendo certo que a concessão de tal proteção não é um processo fácil, apresenta-se um inovador acórdão do TJUE, (C-608/22 e C-609/22), que afirma que o cúmulo das medidas discriminatórias sofridas pelas mulheres afegãs constituem atos de perseguição, tornando-se suficiente o facto de serem mulheres e afegãs para beneficiarem do estatuto de refugiadas.</jats:p>por
dc.description.abstractThe Directive (2011/95/EU) establishes the conditions that applicants for international protection must meet in order to enjoy it. It is part of the CEAS, contributing to the establishment in Europe of an Area of Freedom, Security and Justice, open to third-country nationals who are forced to seek protection in the Union. Based on respect for the 1951 Geneva Convention Relating to the Status of Refugees, the CEAS includes additional measures to protect people at risk of suffering serious violations of their most fundamental rights. Asylum applications are individually assessed by the authorities of the State where the applicant is located, if the applicant demonstrates a well-founded fear of suffering acts of persecution or threats of persecution, based on a limited list of reasons, if they return to their country of origin. Granting such protection is not an easy process, and an innovative ruling by the ECJ (C-608/22 and C-609/22) states that the cumulative discriminatory measures suffered by Afghan women constitute acts of persecution, making the fact that they are women and Afghans sufficient to benefit from refugee status.eng
