Abstract(s)
A presente dissertação versa sobre o estudo do tema do Contrato de edição digital
de obra musical. Esta temática levanta muitas questões. Desde logo, a de se saber se a
digitalização da obra musical lhe aporta diferenças de regime no âmbito do direito de
autor. Bem como a de saber se o contrato de edição digital apresenta especificidades
face ao contrato de edição, que se encontra previsto e regulado pelo Código do Direito
de Autor e dos Direitos Conexos (CDADC).
Para dar resposta a estas questões, iniciaremos o estudo do tema com um breve
enquadramento histórico dos direitos de autor em Portugal.
Seguidamente, partiremos para a análise do objeto do direito de autor, ou seja, a
obra intelectual enquanto objeto do direito de autor. E, aqui, daremos principal
destaque à obra musical que constitui a obra intelectual objeto de estudo da presente
dissertação.
Posteriormente, passaremos para o estudo de algumas questões pertinentes no
âmbito da digitalização de obra protegida.
Analisaremos, ainda, o regime do contrato de edição, previsto e regulado pelo
CDADC, para que, na posse dessa caracterização, possamos aplicar esse regime legal às
especificidades do digital.
This dissertation is about the study of the topic of the digital edition contract of musical works. This theme raises many questions. First of all, if the digitalization of the musical work brings differences in the copyright regime. As well as whether the digital edition contract has specificities in relation to the edition contract which is provided for and regulated by the Copyright and Related Rights Code (CDADC). In order to answer these questions, we will begin our investigation with a brief historical background of copyright in Portugal. Furthermore, we will proceed to the analysis of the object of copyright, namely the intellectual work as object of copyright. And, in this section, we will focus on the musical work, which constitutes the intellectual work object of study in this dissertation. In addition, in our investigation, we will review some pertinent issues in the scope of the digitalization of the protected work. Lastly, we will also analyze the regime of the edition contract, regulated by the CDADC. Once concluded this characterization of the regime, we will verify the legal regime applicability to the specificities of digital edition.
