Abstract(s)
Na sociedade em que vivemos assiste-se a constantes e permanentes mudanças,
potenciando o surgimento de incertezas individuais e coletivas que favorecem o
aparecimento de situações de diferendos e conflitos.
Atendendo à crescente conflitualidade, incumbe a todos a responsabilidade de
descobrir outros modelos de Justiça, alternativos aos Tribunais Judiciais, que possam
responder a todas as solicitações e interesses.
É neste quadro de alternatividade que se enquadra o modelo de Justiça
designado por Julgados de Paz.
A organização interna do Julgado de Paz, bem como a tramitação processual
obedecem a um modelo próprio e específico, diferente do modelo que ocorre nos
tribunais judiciais. É, precisamente, esta diferente organização e tramitação processual
que constitui o objeto do presente Trabalho de Projeto Avançado.
The society we live in is characterised by continuous and permanent changes fostering individual and collective uncertainties which favour the emergence of disputes and conflicted situations. Considering the growing conflicts, it is the responsibility of all of us to find other models of justice, alternative to the Judicial Courts, able of responding to all requests and interests. It is within this framework that the model of justice designated by “Peace Courts” is fitted in. The internal organization of the Peace Court, as well as the procedural process, follow a specific model differing from the model taking place in the judicial courts. It is precisely this different organization and procedural process that constitutes the subject of this Advanced Project Work.
