Abstract(s)
O presente estudo procura analisar o recurso à arbitragem no comércio
internacional, examinando a visão e atitude das empresas portuguesas internacionalizadas
em relação a este método de resolução de litígios, no essencial, contratuais.
Para uma análise completa do tema foram realizadas pesquisas documentais e
bibliográficas, que incluiram a leitura de obras de diversos autores, permitindo analisar e
perceber diferentes perspetivas e informações sobre a temática. Para além disso, a
dissertação, no âmbito da importância atribuída à sua vertente prática, foi ainda
complementada com entrevistas feitas a empresas portuguesas que atuam no contexto
internacional e com estudos de caso relativos à plataforma Jus Mundi e a duas arbitragens
internacionais.
Deste modo, procurou-se entender o papel da arbitragem, perceber se é a opção
mais indicada para resolver litígios comerciais internacionais, aferir as suas vantagens e
desvantagens e compreender se as diversas empresas beneficiam com o seu uso.
Os resultados do estudo, ao nível das entrevistas realizadas, indicam que, para as
empresas portuguesas que atuam no meio internacional, esta ainda não é a escolha de
eleição para resolver conflitos. O mecanismo escolhido para solucionar determinado
litígio dependerá de cada situação e das vantagens e desvantagens envolvidas, assim como
do conhecimento que as empresas detêm sobre os meios alternativos de resolução de
conflitos. Relativamente aos estudos de caso, verificou-se quais os aspetos práticos
essenciais à arbitragem e como as escolhas feitas pelas partes têm impacto no
procedimento arbitral.
The present study seeks to analyze the use of arbitration in international trade, examining the vision and attitude of internationalized Portuguese companies in relation to this method of resolving disputes that are essentially contractual. For a complete analysis of the subject, documentary and bibliographical research was carried out, which included the reading of works by different authors, allowing the analysis and perception of different perspectives and information on the subject. In addition, the dissertation, within the scope of the importance attributed to its practical aspect, was also complemented with interviews carried out with Portuguese companies that operate in the international context and with case studies related to the Jus Mundi platform and two international arbitrations. In this way, it sought to understand the role of arbitration, understand whether it is the most suitable option for resolving international commercial issues, to assess its advantages and disadvantages and understand whether the different companies benefit from its use. The results of the study, regarding the interviews, indicate that, for Portuguese companies operating internationally, this is not yet the preferred choice for resolving conflicts. The mechanism chosen to resolve a particular dispute will depend on each situation and on the advantagens and disadvantages involved, as well as the knowledge that companies have about alternative means of resolving conflicts. Regarding the case studies, it was verified which practical aspects are essential to arbitration and how the choices made by the parties have an impact on the arbitration procedure.
