Abstract(s)
Na ação executiva para pagamento de quantia certa, a tramitação do processo
executivo, nomeadamente na fase de venda dos bens penhorados, exige uma
sequência de atos eficientes por parte do agente de execução, com a finalidade de
obter a satisfação dos interesses do exequente, acautelando os direitos do executado
ou de terceiros, de forma célere e eficaz.
O agente de execução, nesta fase, pratica atos que visam determinar o valor a
atribuir aos bens penhorados e a vender, realiza diligências para proceder à
publicitação dos anúncios, à afixação de editais, bem como pratica atos que resultam
na transmissão dos bens penhorados.
A prossecução dos atos tendentes à venda executiva, se não forem praticados
com diligência, pode acarretar responsabilidade a vários níveis, quer disciplinarmente,
quer civilmente, e, ou, criminalmente para o agente de execução.
Neste Relatório de Projeto Avançado, abordam-se os atos que antecedem a
fase da venda mediante proposta em carta fechada e a venda por negociação
particular, culminando na transferência da titularidade dos bens ou direitos do
executado.
In executive judicial process for the payment of a specific amount, the procedures of the executive process, particularly in the sales phase of seized properties requires a sequence of efficient acts, by the enforcement agent in order to get the satisfaction of creditor interests, cautioning the interests of the debtor or third parties swiftly and effectively. At this stage, the enforcement agent performs certain acts, namely the valuation of the seized assets to be sold, performs diligences to proceed with the publication of the announcements, the display of warnings, as well as practices that result in the transmission of the seized assets. The performance of the acts tending to business sale if they are not practiced diligently can lead responsibility at various levels, whether disciplinary, civilly and criminally or to the enforcement agent. In this Advanced Project Report covers up acts prior to the stage of sale by tender in a sealed letter and sale by private negotiation, culminating in the transfer of ownership of assets or rights of the debtor.
