Abstract(s)
O presente estudo teve como objetivo observar os avanços e recuos do nível de integração regional atingido pelo Mercosul, comparativamente com o experimentado pela União Europeia (UE). Sendo certo que apesar de ambas as entidades internacionais visarem a concretização de um Mercado Comum, é um dado incontroverso que cada uma delas apresenta características e metodologias de atuação distintas, bem como contextos genéticos diferenciados. Se a primeira foi instituída na década de noventa para incrementar a economia regional e a democracia na América do Sul, a segunda surgiu pós segunda Guerra Mundial, com a especial esperança de garantir a paz e a reconstrução da Europa na sua frente econômica e política. Ora, não obstante as dificuldades dos países que integram o Mercado Comum do Sul, causadas – entre outras ordens de razões – pelo receio de que o primado e a autonomia de uma nova ordem jurídica sobre as leis internas possa provocar; da quase impossibilidade de estabelecer um sistema de soluções de controvérsias; bem como pelo deficit do funcionamento institucional sul-americano; é também certo que ambos os espaços desenvolvem relações mútuas, que possibilitam que as experiências da última possam ser o paradigma para a evolução da primeira. Tendo em conta o incipiente nível de integração da “comunidade latino-americana de nações”, principalmente no que se refere à sua dimensão jurídica, acredita-se que o espaço comum sul-americano deve assimilar a experiência e o modelo da União Europeia. A investigação destaca as razões pelas quais a integração europeia tem sido tão bem sucedida. Nestes termos, revelou-se essencial analisar o sistema institucional, os instrumentos normativos, os ordenamentos jurídicos e o modo de solução de controvérsias em ambos blocos, tendo resultado evidente que a existência de um órgão jurisdicional se revela uma condição incontornável para o funcionamento e evolução da ordem jurídica no Mercosul. Do mesmo modo, a consolidação do acordo de associação inter-regional entre Mercosul e UE poderá ser determinante para as relações comerciais das duas regiões, razão pela qual a investigação passa também por uma abordagem aos seus termos essenciais. Acredita-se que tal intercâmbio poderia alavancar a estrutura comunitária da primeira a um nível jamais visto.
This study aimed to observe the progress and setbacks of the level of regional integration achieved by Mercosur compared to that experienced by the European Union (EU). It is true that despite the fact that both international entities aim to achieve a Common Market, it is an incontrovertible fact that each of them presents distinct characteristics and methodologies, as well as different genetic contexts. If the first was instituted in the 1990s to boost the regional economy and democracy in South America, the second came after the Second World War with the special hope of ensuring peace and the reconstruction of Europe on its economic and political front. Notwithstanding the difficulties of the countries that make up the Common Market of the South, caused, among other reasons and reasons, by the fear that the primacy and autonomy of a new juridical order over domestic laws may provoke; the impossibility of establishing a system of dispute settlement; as well as by the deficit of South American institutional functioning; it is also true that both spaces develop mutual relations, which enable the experiences of the latter to be the paradigm for the evolution of the former. Given the incipient level of integration of the "Latin American community of nations", especially in terms of its legal dimension, it is believed that the South American common space should assimilate the experience and the model of the European Union. The research highlights the reasons why European integration has been so successful. In these terms, it was essential to analyze the institutional system, the normative instruments, the legal systems and the way of settling disputes in both blocs. It was evident that the existence of a court is an essential condition for the functioning and evolution of the legal order in Mercosur. Likewise, the consolidation of the interregional association agreement between Mercosur and the EU could be decisive for the trade relations of the two regions. Therefore, research is also based on an approach to its essential terms. It is believed that such an exchange could leverage the Community structure of the former to a level never seen before.
