Abstract(s)
A tradução jurídica é geralmente acreditada como uma das áreas da tradução mais
complexas devido ao seu objeto de estudo e às implicações na sociedade e nas relações
sociais. A equivalência conceptual entre sistemas jurídicos é essencial e deve ser
assegurada. No entanto, esta equivalência requer do tradutor uma meticulosa capacidade
de representar noutra língua o conceito de um outro sistema jurídico, que pode até nem
existir na língua de chegada. Tal pode ser explicado pela diversidade jurídica de sistemas,
cada
um
com
características
e
realidades
conceptuais
distintas,
como
tal,
com
terminologia intrínseca. Devido aos constantes impulsos de harmonização jurídica e
cultural ao nível internacional, desafios linguísticos relacionados com a ausência de
equivalência conceptual necessitaram de ser avaliados e coordenados de modo a
promover a cooperação internacional através da redução de incongruência terminológica.
Iremos ter em consideração os desafios linguísticos apresentados pela integração
europeia, assim como o impacto do direito da União a nível nacional, considerando as
leis como instrumentos de formação e revelação de normas jurídicas. Uma técnica
legislativa que pode potencialmente auxiliar o tradutor é a definição legal, uma vez que
esta técnica está ao dispor do legislador e que lhe permite expandir, limitar ou reconstruir
o conceito da terminologia usada no diploma legal. Estas manipulações conceptuais
representam uma janela por onde os tradutores podem observar as representações e
conceptualizações jurídicas dentro de determinados sistemas jurídicos. Claramente, que
este tipo de perceção é crucial ao tradutor jurídico em contextos da União Europeia.
A presente dissertação propõe explorar os assuntos supramencionados de modo a
apresentar uma explicação coerente sobre a razão pela qual as leis devem ser consideradas
ferramentas de apoio ao tradutor, nomeadamente as técnicas definitórias. Propõe-se ainda
avaliar a importância desta ferramenta na solução de problemas de incongruência
terminológica aos níveis supranacional e nacional.
Legal translation is often regarded as the most challenging area of translation studies due to the subject matter and its implications on society and social relations. It is of utmost importance that the equivalence of concepts from one legal system onto another is assured. However, such equivalence demands a meticulously high capacity from the legal translator to convey in another language the concept from one legal system which might not exist in the target language. This is explained by the multitude of existing legal systems, each with its own characteristics and reality conceptualizations, and therefore inherent terminology. Due to the expanding efforts of legal and cultural harmonization in the international sphere, linguistic challenges regarding the lack of conceptual equivalence needed to be addressed and coordinated in order to improve international cooperation by diminishing terminological incongruency. We will look into the linguistic challenges posed by the integration in the European Union, as well as the impact of Union law at national level, regarding statutes as a legal resource for revelation and formation of legal norms. One legal drafting technique that could potentially assist the legal translator is the legal definition, in the sense that this technique allows legislators to expand, limit or reconstruct concepts of legal terminology in legal instrument. Such conceptual manipulation presents itself as a window for legal translator to look into the legal conceptualizations and representations in certain legal systems. And certainly, such insight is crucial for legal translators in the European Union context. This dissertation proposes to explore the abovementioned notions in order to present a coherent explanation on why statutes should be regarded as tools for legal translators with regards to definition techniques. It also proposes to evaluate the importance of such a tool to solve problems of incongruency at supranational level and national levels.
