Abstract(s)
O presente trabalho tem como objetivo analisar criticamente o princípio da
consensualidade e a sua relevância no regime jurídico da transmissão da
propriedade imobiliária em Portugal. Partindo da sua consagração legal no artigo
408.º do Código Civil, estudam-se a sua fundamentação dogmática, o seu
enquadramento histórico e a sua articulação com os princípios estruturantes do
sistema registal, nomeadamente a publicidade, a prioridade e a oponibilidade.
A investigação incide ainda sobre a natureza do registo predial português,
questionando se este deve ser qualificado como declarativo, constitutivo ou semiconstitutivo.
Para tal, procede-se à análise das principais correntes doutrinárias e
jurisprudenciais, bem como à evolução legislativa, em especial no que respeita ao
conceito de terceiros e à proteção da confiança no tráfico jurídico imobiliário.
Conclui-se que o sistema português é na sua natureza declarativo, em que
coexistem elementos condicionantes de eficácia, refletindo a necessidade de
compatibilizar a autonomia privada com a segurança das transações. O estudo
aponta ainda para a pertinência de uma eventual revisão legislativa, no sentido de
clarificar a relação entre a eficácia dos negócios jurídicos e a oponibilidade perante
terceiros.
This paper aims to critically analyze the principle of consensuality and its relevance in the legal framework for the transfer of real estate property in Portugal. Based on its legal enshrinement in Article 408 of the Civil Code, we examine its dogmatic foundation, its historical framework, and its articulation with the structuring principles of the registration system, particularly publicity, the priority and enforceability. The research also focuses on the nature of the Portuguese real estate registry, questioning whether it should be classified as declaratory, constitutive, or semi-constitutive. To this end, we analyze the main doctrinal and jurisprudential currents, as well as legislative developments, particularly regarding the concept of third parties and the protection of trust in real estate legal transactions. We conclude that the Portuguese system is declaratory in nature, with elements that condition effectiveness, reflecting the need to reconcile private autonomy with transactional security. The study also highlights the relevance of a possible legislative review, in order to clarify the relationship between the effectiveness of legal transactions and their enforceability against third parties.
