A proteção internacional dos refugiados: violação de direitos humanos e a concessão de proteção subsidiária sob a égide da legislação da união europeia

| dc.description.abstract | A presente dissertação tem como objetivo analisar criticamente o Sistema Europeu Comum de Asilo (SECA), à luz da evolução histórica do Direito Internacional dos Refugiados e dos desafios contemporâneos enfrentados pela União Europeia no campo da proteção internacional. Com enfoque na proteção subsidiária como mecanismo essencial diante de situações de grave violação dos direitos humanos, a pesquisa examina de que forma a legislação da União Europeia estrutura a concessão dessa modalidade de proteção para além do asilo convencional, especialmente em cenários de conflitos armados, violência indiscriminada e riscos à integridade física dos solicitantes. Partindo da Convenção Relativa ao Estatuto dos Refugiados de 1951 e no seu Protocolo de 1967. O estudo contextualiza o surgimento do SECA no âmbito da evolução da política europeia de asilo, destacando os marcos regulatórios e os mecanismos de harmonização propostos pela União Europeia. Em seguida, analisa criticamente as três diretivas centrais do sistema – diretiva qualificatória, diretiva de procedimentos e diretiva de acolhimento – evidenciando como sua implementação varia de forma significativa entre os Estados-membros, gerando insegurança jurídica e afetando a equidade no acesso à proteção. Examina-se o Novo Pacto Europeu sobre Migração e Asilo, suas propostas de reforma e os riscos de retrocesso nas garantias fundamentais. Serão apresentadas as alternativas para fortalecer o regime europeu de proteção. Conclui-se que, para assegurar um sistema mais justo, eficaz e coerente com os princípios dos direitos humanos, é imprescindível que a União Europeia avance na implementação de políticas migratórias baseadas na uniformidade, solidariedade, na responsabilidade compartilhada e no respeito à dignidade humana. | por |
| dc.description.abstract | This dissertation aims to critically analyze the Common European Asylum System (CEAS), in the light of the historical evolution of International Refugee Law and the contemporary challenges faced by the European Union in the field of international protection. Focusing on subsidiary protection as an essential mechanism in situations of serious human rights violations, the research examines how European Union legislation structures the granting of this type of protection beyond conventional asylum, especially in scenarios of armed conflict, indiscriminate violence and risks to the physical integrity of applicants. Building on the 1951 Convention relating to the Status of Refugees and its 1967 Protocol. The study contextualizes the emergence of the SECA in the context of the evolution of European asylum policy, highlighting the regulatory frameworks and harmonization mechanisms proposed by the European Union. It then critically analyzes the three central directives of the system – the qualifying directive, the procedures directive and the reception directive – showing how their implementation varies significantly among the Member States, generating legal uncertainty and affecting equity in access to protection. It examines the New European Pact on Migration and Asylum, its reform proposals and the risks of regression in fundamental guarantees. Alternatives to strengthen the European protection regime will be presented. It is concluded that, in order to ensure a fairer, more effective and coherent system with the principles of human rights, it is essential that the European Union advances in the implementation of migration policies based on uniformity, solidarity, shared responsibility and respect for human dignity. | eng |
