Abstract(s)
A presente investigação centra-se na análise da aplicabilidade da Inteligência Artificial no contexto do Tribunal de Justiça da União Europeia, partindo da necessidade de adequar o Direito e a área jurídica em geral, aos avanços tecnológicos que moldam a sociedade atual. O estudo tem como objetivo primordial a elaboração de uma framework orientadora para a potencial integração de sistemas de IA no TJUE, contemplando para o efeito dimensões técnicas, jurídicas e éticas. A fim de alcançar os objetivos, procedeu-se à identificação e categorização de diferentes sistemas já implementados nas mais diversas jurisdições internacionais. Considerou-se ainda o enquadramento normativo europeu, nomeadamente o Regulamento Geral sobre a Proteção de Dados (RGPD), o AI Act, a Carta Europeia de Ética sobre a Utilização da Inteligência Artificial em Sistemas Judiciais, entre outros. Os resultados obtidos permitem afirmar que a aplicação de sistemas de IA no TJUE é viável e potencialmente benéfica, desde que acompanhada de salvaguardas jurídicas e éticas robustas, bem como de mecanismos de supervisão humana contínua
This research focuses on analyzing the applicability of Artificial Intelligence in the context of the Court of Justice of the European Union, based on the need to adapt law and the legal field in general to the technological advances shaping today's society. The study's primary objective is to develop a guiding framework for the potential integration of AI systems in the CJEU, considering technical, legal, and ethical dimensions. To achieve these objectives, we identified and categorized various systems already implemented in a wide range of international jurisdictions. We also considered the European regulatory framework, namely the General Data Protection Regulation (GDPR), the AI Act, the European Charter of Ethics on the Use of Artificial Intelligence in Judicial Systems, among others. The results obtained allow us to affirm that the application of AI systems in the CJEU is feasible and potentially beneficial, provided it is accompanied by robust legal and ethical safeguards, as well as mechanisms for continuous human oversight
