| dc.description.abstract | O presente estudo versa sobre a hipoteca, fazendo uma breve descrição deste instituto jurídico, principais características, vicissitudes e vulnerabilidades. Nesse sentido é apresentada a perspetiva do credor enquanto potencial prejudicado com eventuais diminuições da sua garantia. A Hipoteca é tida vulgarmente como uma das mais fortes e credíveis garantias, “a rainha das garantias” na opinião de muitos autores, mas esta presunção, somada ao desconhecimento por parte dos credores dos eventuais riscos pode representar perdas patrimoniais expressivas no momento de executar a mesma. Apesar de se verificar que existe atualmente uma posição doutrinal e jurisprudencial comum e homogénea sobre os temas em apreço, concluímos, pela leitura de vários autores e acórdãos, que se verifica muitas vezes um desconforto na aplicabilidade das regras jurídicas aplicáveis à hipoteca. | por |
| dc.description.abstract | This study is about the mortgage, giving a brief description of it, the main characteristics, vicissitudes and vulnerabilities. In this sense the perspective of the lender while impaired with any potential decreases they warranty is provided. The mortgage is commonly regarded as one of the strongest and most credible guarantees, "the queen of guarantees" in the opinion of many authors, but this presumption, coupled with the ignorance on the part of creditors of possible risks can represent significant financial losses when executing the thereof. Although it appears that the large majority there is currently a common and homogeneous, doctrinal and jurisprudential position on the issues, we conclude by reading various authors and judgments that occurs discomfort in the applicability of the same. | eng |
