dc.description.abstractCom este projeto avançado aprofundamos o regime inovador introduzido pela Lei n.º 48/2018 de 14 de Agosto, o regime da renúncia recíproca à condição de herdeiro legitimário. Iniciamos, assim a abordagem ao tema com uma breve introdução ao direito das sucessões, crucial para o entendimento de aspetos que serão contemplados no decorrer deste estudo. De seguida, a evolução histórica assume um papel de especial relevo, pois permite-nos compreender as alterações legislativas subsequentes, tais como as incidentes sobre o regime de bens supletivo e a posição sucessória do cônjuge sobrevivo. Percorrido este caminho, e porque juntamente com o aspeto inovador houve a necessidade de desvendar os motivos subjacentes à alteração referida, analisamos a proposta de lei e os pareceres emitidos. Posto isto, estão reunidas as condições para que seja possível desvendar o regime da renúncia recíproca, quais os requisitos e em que circunstâncias, fazendo um ponto de ligação com a aplicabilidade prática do mesmo e do seu impacto no ordenamento jurídico português.pt_PT
dc.description.abstractWith this advanced project we deepen the innovative regime introduced by Law no. 48/2018 of 14 August, the regime of reciprocal renunciation to the condition of legitimate heir. Thus, we started the approach to the theme with a brief introduction to the right of successions, crucial for understanding aspects that will be contemplated in the course of this study. Next, historical developments takes on a particularly important role, as it allows us to understand subsequent legislative changes, such as incidents on the supplementary matrimonial property and the surviving spouse's position. Completed this journey, and because together with the innovative aspect there was a need to uncover the reasons behind the amendment referred to, we examine the proposal for law and the opinions issued. Having said that, the conditions for the unveiling of the regime of reciprocal renunciation, what the requirements and under what circumstances, making a point of connection with the practical applicability of the same and its impact on the legal system of the Portuguese are met.pt_PT
