Abstract(s)
O presente estudo surge no âmbito do segundo ano do segundo ciclo de estudos em Solicitadoria, exigido para obtenção do grau de mestre e versa sobre a temática da anulabilidade da venda executiva. O nosso objetivo passa por analisar se uma venda defeituosa executiva é anulável ou não, e se for qual será a sua base legal.
Porém, antes da alusão ao tema principal, iremos abordar de forma introdutória como é tramitada a venda executiva, explicitando as suas modalidades, os efeitos que esta produz, em que casos poderá ser anulável e a sua natureza.
Abordaremos também a anulabilidade da venda executiva com o fundamento da venda defeituosa, dando especial relevância à venda defeituosa à luz do Código Civil e do Decreto-Lei 67/2003, de 08 de abril, bem como à interpretação do art.838.º do Código de Processo Civil.
The present study is part of the second year of the second study cycle in Law for Solicitors, which is required to obtain a master’s degree, and deals with the topic of the voidability of the execution sale. Our objective is to analyses whether an execution sale is voidable or not, and if it is, what is its legal basis. However, before alluding to the main topic, we will address in an introductory way how the execution sale is conducted, explaining its modalities, the effects it produces, how it may be voidable and its nature. We will also deal with the voidability of the execution sale on the grounds of a defective sale, giving special relevance to the defective sale in light of the Civil Code and Decree-Law 67/2003 of 08 April, as well as the interpretation of Article 838.º of the Code of Civil Procedure.
