Abstract(s)
O trabalho que elaboramos tem por objeto o registo das operações de transformação fundiária resultantes de reparcelamento.
No primeiro capítulo tentamos dar uma noção de urbanismo, abordamos a questão do surgimento deste direito e desenvolvemos alguns aspetos do urbanismo, designadamente no seu aspeto social e, sobretudo, na vertente política, enquanto instituto de remodelação e transformação dos solos.
O segundo capítulo trata dos planos e da necessidade da planificação. Elegemos o plano de pormenor como prioridade do nosso estudo, por poder fundar diretamente operações de transformação fundiária sem necessidade de qualquer controlo administrativo posterior e, nessa medida, ser título bastante para o registo da operação.
No terceiro capítulo atendemos aos aspetos registais, designadamente aos fins do registo e, sobretudo, às regras de funcionamento do sistema registal português, assente na descrição dos prédios e nos princípios registais. Estes constituem regras básicas para que o sistema registal português seja considerado um sistema seguro e confiável e mereça, por parte do poder decisório, dos cidadãos e dos agentes económicos, a confiança necessária e suficiente para alcançar a segurança jurídica no tráfico jurídico imobiliário. Neste âmbito, tecemos, também, algumas considerações aos efeitos do registo, mormente ao efeito consolidativo, presuntivo e aquisitivo ou tabular.
No quarto capítulo tratamos do registo da operação de transformação fundiária resultante de reparcelamento. Começamos por dar a noção de reparcelamento e as diversas formas atinentes à sua titulação. Caraterizamos os contratos de urbanização e desenvolvimento, indispensáveis à regulação dos direitos e obrigações das pessoas, singulares ou coletivas, intervenientes na operação.
Explicamos como se efetua o registo deste facto e os efeitos que se produzem com o reparcelamento.Terminamos como a noção de reparcelamento no Regime Jurídico da Urbanização e Edificação (RJUE).
O método utilizado assenta numa análise das questões tratadas, com recurso a autores, doutrina e jurisprudência relevantes nesta matéria.
The work we produce has the purpose the registry of the processing operations resulting from land reparcelling. In the first chapter we try to give a sense of urbanism, we address the question of the appearance of this right and develop some aspects of urbanism, especially in its social aspect and particularly on the political, while institute refurbishment and transformation of soil. The second chapter is devoted to plans and the need for planning. We chose the detailed plan as a priority of our study, to be able to found directly processing operations land without any subsequent administrative control and in this respect, be a sufficient basis for the registration of the operation. In the third chapter serve to registration aspects, particularly the purpose of the registration and, above all, the rules of operation of the Portuguese registration system, based on the description of the buildings and the rules of registry. These are the basic rules for the Portuguese registration system is considered a secure and reliable system and deserve, by the decision makers, citizens and economic agents, trust necessary and sufficient to achieve legal certainty trafficking legal estate. In this context, we weave also some considerations to the effects of registration especially the effect consolidativo, and presumptive acquisitive or tabular. In the fourth chapter dealt with the registration of land transformation the operation resulting from reparcelling. We start with the notion of reparcelling and various forms relating to titration. We alluded to contracts of urbanization and development, essential for regulating the rights and obligations of persons, natural or legal, in the operation. Explained with how to registry this fact and the effects that occur with the reparcelling. Finished as the notion of reparcelling the Legal Regime of Urbanization and Construction (RJUE). The method used is based on an analysis of the issues addressed, using authors, doctrine and jurisprudence relevant in this area.
