Abstract(s)
Através de uma abordagem monográfica, compilada e organizada
pretende-se com o presente trabalho uma análise dos princípios consagrados no
direito internacional em matéria de direito da nacionalidade, enquanto princípios
informadores das regras de concessão da nacionalidade.
Historicamente, tem-se entendido, que estas matérias recaem sob a
jurisdição interna de cada Estado, não obstante esta matéria pode ser limitada,
não só pelas ações de outros Estados, bem como pelo direito internacional.
Assim, analisaremos princípios que são um verdadeiro limite à
discricionariedade dos Estados em matéria de concessão da nacionalidade.
Tendo como ponto de partida a distinção que o regime legal português
estabelece entre atribuição de nacionalidade (nacionalidade originária) e
aquisição de nacionalidade (nacionalidade derivada), abordaremos as opções
do legislador português nesta matéria, opções essas, muitas vezes de carácter
politico, identitárias e ideológicas, e associadas a politicas de imigração
E, porque estes princípios assumem particular importância na chamada
aquisição derivada da nacionalidade, ou seja, aquela que é adquirida por outro
ato ou facto jurídico em momento posterior ao nascimento, analisaremos a sua
evolução histórica na legislação portuguesa, com especial destaque para a
aquisição por naturalização.
Efetuaremos uma análise sumária das questões mais relevantes em sede
de instrução e tramitação dos processos de naturalização, que representam,
atualmente, o maior número de pedidos de nacionalidade portuguesa.
Neste contexto, analisaremos algum direito comparado bem como alguma
da mais relevante bibliografia existente sobre esta matéria.
Through a monographic, compiled and organized approach, this work aims to analyse the principles enshrined in international law in matters of nationality law, as principles that inform the rules for granting nationality. Historically these matters fall under the internal jurisdiction of each State, although this matter may be limited, not only by the actions of other States, but also by international law. Thus, we will analyse principles that are a real limit to the discretion of States in terms of granting nationality. Taking as a starting point the distinction that the Portuguese legal regime establishes between attribution of nationality (original nationality) and acquisition of nationality (derived nationality), we will address the options of the Portuguese legislator in this matter, options that are often of a political, identity and ideological, and associated with immigration policies In addition, because these principles assume particular importance in the so-called acquisition derived from nationality, that is, the one that is acquired by another legal act or fact after the birth, we will analyse its historical evolution in Portuguese legislation, with special emphasis on the acquisition by naturalization. We will carry out a summary analysis of the most relevant issues in terms of instruction and processing of naturalization processes, which currently represent the largest number of requests for Portuguese nationality. In this context, we will analyse some comparative law as well as some of the most relevant existing bibliography on this matter.
