No seguimento do Mestrado em Solicitadoria, e no âmbito da Unidade Curricular de Projeto Avançado, incumbe a cada um dos mestrandos a concretização de um projeto avançado, que in casu, versa sobre a temática: “O princípio do trato sucessivo versus legitimação de direitos – aproximações e afastamentos”, enquadrada no Registo Predial.
Porquanto, o trato sucessivo constitui um pressuposto do sistema registral, capaz de tutelar e promover a segurança no comércio jurídico imobiliário, essencialmente, no que concerne à lógica da continuidade das inscrições.
Em boa verdade, o trato sucessivo prevê duas modalidades: os números 1, 2 e 3 do art.º 34º do CRPred dizem respeito ao trato sucessivo na modalidade da inscrição prévia; já no que tange ao N.º 4, observa-se a continuidade das inscrições.
Assinale-se que é o titular inscrito que está legitimado para alienar ou onerar o prédio em causa, devendo demonstrar que o prédio está registado a seu favor, cumprindo-se princípio da legitimação consagrado no art.º 9º do CRPred.
O método utilizado para trabalhar nesta vertente de investigação jurídica, assentará, essencialmente, em dois polos, como sejam, por um lado, análise de referências bibliográficas, conjugadas, por outro, com o exame de Jurisprudência portuguesa e Pareceres/Orientações do Instituto dos Registos e do Notariado.
Por fim, evidenciamos a existência de bibliografia relacionada com a temática em apreço, o que apraz proclamar que é um tópico gerador de alguma discussão no plano doutrinal, pelo que ao longo da escrita do projeto avançado procuraremos discorrer e aprofundar a letra da lei, naquilo que é o seu entendimento, sempre que possível com recurso a jurisprudência e doutrina.
Following the Master's in Solicitorship, and within the scope of the Curricular Unit of Advanced Project, it is up to each of the master's students to carry out an advanced project, which in casu, deals with the theme: "The principle of successive treatment versus legitimation of rights – approximations and departures”, framed in the Land Registry. Because the successive treatment constitutes a presupposition of the registration system, capable of protecting and promoting security in the real estate legal trade, essentially, about the logic of continuity of registrations. In truth, the successive agreement foresees two modalities: numbers 1, 2 and 3 of article 34 of the CRPred concern the successive agreement in the modality of prior registration; regarding Nº 4, the continuity of the inscriptions can be observed. It should be noted that it is the registered holder who is entitled to dispose of or encumber the property in question and must demonstrate that the property is registered in his favor, complying with the principle of legitimation enshrined in article 9 of the CRPred. The method used to work in this aspect of legal research was essentially based on two poles, namely, on the one hand, some analysis of bibliographic references, combined, on the other, with the examination of some Portuguese Jurisprudence and Opinions/Guidelines of the Institute of Registries and of the Notary. Finally, we evidence the existence of some bibliography related to the subject in question, which we are pleased to proclaim that it is a topic that generates some discussion on the doctrinal level, so throughout the writing of the advanced project we will seek to discuss and deepen the letter of the law, in what is its understanding, whenever possible with recourse to jurisprudence.
