| dc.description.abstract | O trabalho que ora apresentamos versa sobre a penhora e, essencialmente, sobre o registo da mesma. A penhora, constitui um ato judicial exclusivo do processo executivo, muito recorrente nos dias de hoje, face à atual conjuntura económico-social em que, infelizmente, nos encontramos. A abordagem deste tema, tem como ponto de partida, uma breve referência histórica a esta figura, por forma a permitir compreender a evolução do conceito e procedimentos no âmbito do processo executivo. Tecemos, depois, algumas considerações aos princípios registais, esclarecendo o seu conteúdo e alcance, como condições essenciais para que o registo atinja os fins para que foi criado, que é o dar publicidade à situação jurídica dos prédios, tendo em vista alcançar a segurança jurídica no tráfico jurídicos dos imóveis. Neste âmbito, abordamos, igualmente, os efeitos que se produzem com o registo. Ocupa-nos grande parte do trabalho o registo da penhora e as vissitudes que preenchem o quotidiano quer dos Agentes de Execução quer das Conservatórias do Registo Predial. Tentamos demonstar que o registo tem, atualmente, um efeito constitutivo, no registo da penhora, porque o efeito real de garantia apenas existe depois de registada a penhora, na medida em que, legalmente, a penhora se realiza com o registo. Não nos limitamos ao registo da penhora sobre prédios já descritos, sendo objeto deste trabalho, entre outros, o registo de penhora de prédios ainda por descrever, o registo de penhora de direitos, de bens indivisos, de quotas de sociedades e de partes de prédios. O método utilizado foi o descritivo, com recurso à legislação, doutrina e jusrisprudência mais relevantes nesta matéria. | por |
| dc.description.abstract | The central theme of this work focus on the attachment, which is a judicial act, exclusive of the executive process, very recurrent nowadays, given the current economic and social situation in which, unfortunately, we find ourselves. The approach in this area has as a starting point, a brief historical reference to this figure, in order to allow an understanding of the evolution of the concept and procedures in the execution process. After, we make some considerations to the principles registais, clarifying its scope and content, such as essential conditions for which the registration reaches the purposes for which it was created, which is the giving publicity to the legal situation of the buildings, with a view to achieving legal certainty in legal trafficking of immovable property. In this context, we, also approach, in the same way, the effects that they produce with the registration. Occupies us great part of the work, the registration of the lien and the vicissitudes which fulfill the daily life of both Agents of Implementation and Land Registry Offices. We have tried to demonstrate that the register has, currently, a constitutive effect, in the register of attachment, because the real effect of warranty only exists after the registered lien, in so far as that, legally, the lien is realized with the registration. We do not confine ourselves to the registration of the lien on buildings already described, being object of this work, among others, the registration of lien of buildings still to describe, the registration of lien rights, goods indivisible, of shares of companies and parts of buildings.
