Abstract(s)
Este estudo possuí como objetivo caracterizar os aspetos jurídicos da recuperação de
empresas por trabalhadores através de empreendimentos de autogestão no Brasil e em
Portugal, a partir do regime jurídico de insolvência e falência, com análise da adequação
da forma jurídica e enquadramento para o desenvolvimento das atividades por
empreendimentos de autogestão. O estudo socorre-se de uma investigação qualitativa,
tendo em vista o contexto histórico e socioeconómico abordados relativamente ao exame
de experiências concretas por estudo de casos, no contexto da economia social e solidária.
Mediante a comparação e identificação dos avanços e dificuldades da legislação e
regulamentação existente, concernente a recuperação de empresas por empreendimentos
de autogestão em ambos os países, conclui-se que o arcabolço juridico da economia social
em Portugal é bem estruturado e a economia solidária no Brasil está em contrução de um
sistema normativo edificante, contudo, a legislação brasileira possui condições mais
favoráveis para a recuperação de empresas por trabalhadores.
The aim of this study is to characterise the legal aspects of business recovery by workers through self-management ventures in Brazil and Portugal, based on the legal regime of insolvency and bankruptcy, with an analysis of the suitability of the legal form and framework for the development of activities by self-management ventures. The study uses qualitative research in view of the historical and socio-economic context addressed in relation to the examination of concrete experiences through case studies in the context of the social and solidarity economy. By comparing and identifying the progress and difficulties of existing legislation and regulations concerning business recovery by self managed enterprises in both countries, it is concluded that the legal framework of the social economy in Portugal is well structured and the solidarity economy in Brazil is in the process of building an edifying regulatory system. However, Brazilian legislation has more favourable conditions for the recovery of companies by workers.
