| dc.description.abstract | A penhora do quinhão hereditário é aquela que é realizada com base em assunções sobre a composição do património que integra a herança e, por isso, com uma menor segurança jurídica para o adquirente deste direito, constituindo uma problemática para a credibilidade e eficácia na venda executiva. Para além do preço, o adquirente de quinhões hereditários na venda judicial em que do acervo da herança façam parte bens imóveis, terá ainda que suportar os custos inerentes à obtenção do título e os respetivos impostos, na certeza, porém, que só com a partilha será possível apurar o que efetivamente lhe cabe na herança. Pretende-se assim, pela abordagem das questões processuais, registais e fiscais, demonstrar os constrangimentos da penhora, do registo e da venda do quinhão hereditário, bem como os riscos assumidos pelo adquirente desse direito, apesentando-se soluções para que a venda executiva neste âmbito seja mais segura, credível, célere e eficaz. | pt_PT |
| dc.description.abstract | The pledge of the hereditary share is a pledge based on assumptions on the patrimony that composes the inheritance and does not present any legal certainty for the acquirer of this right, causing a problem for the credibility and effectiveness in the executive sale. In addition to the price, the acquirer of hereditary shares in the legal sale, in which is included real estate, shall also bear the costs of obtaining the title and the related taxes to his share, however, only by sharing will it be possible to determine what belongs to the inheritance. Thus, our purpose is to address procedural, registered, and fiscal issues, in order to demonstrate the constraints of the pledge, registration and sale of the hereditary share, as well as the risks assumed by the acquirer of that right, calling for solutions to ensure that the sale in this area is safer, more credible, faster and more effective. | pt_PT |
