Abstract(s)
O interesse crescente do recurso à contratualização na Administração Pública demonstra uma evolução na forma como a mesma é percecionada, porquanto, embora a Administração Pública continue a ser considerada uma Administração de autoridade, atualmente procura formas de atuação administrativa alternativas à típica estatuição autoritária consubstanciada no ato administrativo, recorrendo, não raras vezes, a uma forma de atuação administrativa pactuada: o contrato administrativo.
Na verdade, o certo é que, apesar das hesitações iniciais sobre a admissão da figura do contrato no domínio do Direito Administrativo, a possibilidade de a Administração Pública se vincular através de contratos remonta a tempos antigos.
Não obstante, e como não poderia deixar de ser, a Administração Pública, não prescindiu dos seus poderes públicos de autoridade, pois a prossecução do interesse público exige que, ainda que contratualmente, exista a administratividade da sua atuação. Assim, o atual regime jurídico caracteriza-se pela conjugação da autoridade e supremacia da Administração Pública por um lado e consensualidade e pacto, por outro.
Ora, existem, no contrato administrativo, especificidades diretamente decorrentes do facto de o mesmo, além de definir os direitos e obrigações das partes, se traduzir simultaneamente num instrumento para a prossecução de interesses públicos. Justifica-se, assim, o interesse do tema a que nos propomos abordar com a realização deste Projeto Avançado, são precisamente essas especificidades que constituem o objeto central do nosso estudo.
The growing interest in resorting to contractualization in Public Administration demonstrates an evolution in the way it is perceived, since, although the Public Administration continues to be considered an Administration of authority, it is currently looking for alternative forms of administrative action to the typical authoritarian statute embodied in the act administrative, resorting, not infrequently, to a form of administrative action agreed upon: the administrative contract. In fact, what is certain is that, despite initial hesitations about the admission of the contract figure in the domain of Administrative Law, the possibility of the Public Administration being bound through contracts goes back to ancient times. Nevertheless, and as it could not be otherwise, the Public Administration did not dispense with its public powers of authority, as the pursuit of the public interest requires that, even contractually, there is the administrative nature of its performance. Thus, the current legal regime is characterized by the combination of authority and supremacy of the Public Administration, on the one hand, and consensuality and pact, on the other. However, there are, in the administrative contract, specificities directly resulting from the fact that it, in addition to defining the rights and obligations of the parties, is simultaneously translated into an instrument for the pursuit of public interests. Thus, the interest of the subject that we propose to address with the realization of this Advanced Project is justified, it is precisely these specificities that constitute the central object of our study.
