Abstract(s)
Existe, na nossa vida quotidiana, um vasto conjunto de problemas relacionados com a
realização do contrato de compra e venda, regulado nos arts. 874º e ss. do Código Civil.
De entre as perturbações típicas deste tipo de contrato, todas elas relacionadas com o
cumprimento das prestações que impendem sobre as partes – a venda de bens alheios, a
venda de bens onerados, entre outras –, a venda de coisas defeituosas será aqui considerada
a mais importante, existindo dois principais regimes jurídicos que lhe são aplicáveis, conforme
a incidência subjetiva em causa: o regime da venda de coisas defeituosas, previsto nos arts.
913º a 922º do Código Civil e o regime jurídico específico do Decreto-Lei nº 67/2003, de 8 de
Abril, que se dedica à venda de bens de consumo e às garantias a ela relativas.
Em qualquer destas normas, estão elencados diversos meios de tutela conferidos ao
comprador e ao consumidor, respetivamente, que lhes permitem reagir face a esta
perturbação. No entanto, para que se conclua pela existência de venda de coisa defeituosa,
ou de bem de consumo desconforme com o contrato, é necessário que o defeito da coisa ou
a desconformidade do bem, embora manifestados ou exteriorizados em momento posterior,
já existam aquando da realização da compra e venda.
There is in one’s daily life a great amount of issues related to the conclude of a sales/ purchase contract regulated by the Article 874 and the following articles of the Civil Code. Among the tradicional disruptions of this type of contract, all of them related to the recognition of benefits granted to the parts – the sailing of unrelated goods, encumbered ones, among others –, the saling of defective goods will be considered the most important, and there is two main legal frameworks applicable to it, depending on the subjective ocurrence in hand: the regulation of defective sales, in accordance with the Articles 913 to 922 of the Civil Code and the specific legal regime of the Decree-Law Nr. 67/2003, 8. April, which deals with consumer goods sales and the guarantees provided. In any of these standards are available various means of guardianship entitled to the buyer and seller, respectively, enabling them to respond to the disruption. However, in order to conclude the existence of the sailing of defective good or consumer good not complied with the contract, it is necessary that the defect of the thing or the lack of conformity in the good, althoug expressed ou shown at a later time, already exists when purchasing or selling.
