dc.description.abstractA gestão de ativos pelos fundos de investimento registou um crescimento sem precedentes nas últimas duas décadas a ultrapassar os 60 biliões de euros em 2024. Neste contexto, o Luxemburgo e a Irlanda consolidaram-se como os líderes incontestados europeus e mundiais na domiciliação de fundos: juntos albergam mais de 60 % de todos os fundos de investimento transfronteiriços distribuídos na União Europeia e constituem a escolha principal para promotores não europeus (gestores dos Estados Unidos da América, Reino Unido, asiáticos e do Médio Oriente) quando pretendem estabelecer um hub europeu. Ambos os países construíram, de forma deliberada, ecossistemas de fundos sofisticados, estáveis e altamente atrativos, que combinam regimes fiscais favoráveis, veículos jurídicos flexíveis e modernos, processos de autorização rápidos (product-to-market), um vasto leque de prestadores de serviços experientes, autoridades de supervisão previsíveis e pró-business, numa total conformidade com os enquadramentos Undertakings for Collective Investment in Transferable Securities (UCITS) e Alternative Investment Fund Managers Directive (AIFMD), que garantem direitos de passaporte em todo o Espaço Económico Europeu. A presente dissertação tem como objetivo identificar e analisar os principais fatores económicos, fiscais, jurídicos, regulatórios e operacionais que explicam porque é que os gestores de ativos globais preferem sistematicamente o Luxemburgo e a Irlanda em detrimento de Portugal quando estabelecem ou relocalizam a sede dos seus fundos. Compreender estas determinantes é crucial para decisores políticos, reguladores e centros financeiros concorrentes que pretendam atrair ou reter negócio de fundos de investimento num ambiente cada vez mais competitivo.por
dc.description.abstractAsset management by investment funds has experienced unprecedented growth over the past two decades, exceeding €60 billion in 2024. In this context, Luxembourg and Ireland have consolidated their position as the undisputed European and global leaders in fund domiciliation: together they host more than 60% of all cross-border investment funds distributed in the European Union and are the primary choice for non-European investors (managers from the United States, the United Kingdom, Asia and the Middle East) when seeking to establish a European hub. Both countries have deliberately built sophisticated, stable, and highly attractive fund ecosystems that combine favorable tax regimes, flexible and modern legal vehicles, fast (product-to-market) authorization processes, a wide range of experienced service providers, predictable and pro-business supervisory authorities, in full compliance with the Undertakings for Collective Investment in Transferable Securities (UCITS) and Alternative Investment Fund Managers Directive (AIFMD) frameworks, which guarantee passporting rights throughout the European Economic Area. This dissertation aims to identify and analyze the main economic, fiscal, legal, regulatory, and operational factors that explain why global asset managers systematically prefer Luxembourg and Ireland over Portugal when establishing or relocating the headquarters of their funds. Understanding these determinants is crucial for policymakers, regulators, and competing financial centers seeking to attract or retain investment fund business in an increasingly competitive environment.eng
